Terms & Conditions

1. Introduction

By booking a tour, hike, or homestay experience through this website or with Borneo Off Trail (“the Company”), you agree to the following Terms & Conditions. These apply to all services provided, including jungle trekking, transport, and accomodation.

2. Nature of Activities

Our experiences include jungle hiking, river crossings, uneven terrain, potential wildlife encounters, and rural living conditions. These activities involve inherent risks.

By booking, guests acknowledge that:

  • Conditions may be physically demanding
  • Weather and terrain can be unpredictable
  • Access to medical facilities may be limited

3. Health & Fitness

Guests must:

  • Be in reasonable physical condition
  • Inform us of any medical conditions, allergies, or injuries
  • Follow all safety instructions given by the guide

The Company reserves the right to refuse participation if a guest’s condition may pose a risk.

4. Assumption of Risk

Guests participate at their own risk.

The Company and guide are not liable for:

  • Personal injury
  • Illness
  • Loss or damage to personal belongings
  • Delays caused by weather, road conditions, or unforeseen circumstances

5. Bookings & Payments

  • Bookings are confirmed upon deposit or full payment
  • Remaining balance (if applicable) must be paid before the experience begins
  • Prices may vary depending on group size and itinerary

6. Cancellations & Refunds

By Guests:

  • More than 7 days before: Full refund (minus any transaction fees)
  • 3–7 days before: 50% refund
  • Less than 48 hours: No refund

By the Company:

We reserve the right to cancel due to:

  • Unsafe weather conditions
  • Safety concerns
  • Unforeseen circumstances

In such cases, guests will be offered:

  • A rescheduled date, or
  • A full refund

7. Weather & Itinerary Changes

Jungle conditions can change quickly. We may:

  • Adjust routes
  • Change timings
  • Modify activities

This is done for safety and experience quality, and does not qualify for refunds.

8. Transport

Transport is provided as part of the experience where applicable. While we take all reasonable care:

  • Travel times may vary
  • Road conditions may be unpredictable

9. Homestay Experience

Our homestay is:

  • Simple, local, and authentic
  • Not comparable to hotels or luxury accommodation

By booking, guests accept:

  • Basic facilities
  • Shared spaces
  • Local food and lifestyle

10. Respect & Conduct

Guests are expected to:

  • Respect local culture, family, and property
  • Follow guide instructions at all times
  • Act responsibly toward nature and wildlife

We reserve the right to remove any guest whose behaviour is unsafe or disrespectful, without refund.

11. Environmental Responsibility

We operate with a leave-no-trace philosophy. Guests must:

  • Avoid littering
  • Respect wildlife
  • Minimise environmental impact

12. Photography & Media

We may take photos/videos during experiences for promotional use.
If you prefer not to be included, please inform us in advance.

13. Travel Insurance

Guests are strongly advised to have:

  • Travel insurance
  • Medical coverage

14. Liability Waiver

By participating, guests agree that:

  • They understand the risks involved
  • They voluntarily take part in all activities
  • They release the Company and guide from liability to the fullest extent permitted by law

15. Governing Law

These Terms & Conditions are governed by the laws of Brunei Darussalam.
